“Each additional day of delay carries the weight of everything Charlie’s murder has taken from his family, especially his two young children, who were just 3 and 1 when their father was killed, and who will be 7 and 5 when the verdict is given under the Defense’s proposed schedule,” Erika’s attorney said. Erika, 37, and her attorney believe the defense’s tentative trial target for the third quarter of 2029 is “a timeline grossly out of line with comparable cases.”
They are seeking a hearing date no later than October 4, 2027, the government’s proposed preparation date.
“Each hearing evokes anxiety, pain and grief,” Erika’s lawyer said in court documents. “The Kirk family deserves to have this matter resolved quickly.”
Erika’s team is also pushing for a 2027 start date, claiming “the cost to the public is also significant.”
“Not only are conspiracy theorists, trolls, click-hunters, and outrage seekers taking advantage of the uncertainty caused by the delay to spin tales that undermine confidence in the State of Utah and its justice system, but taxpayers are also paying an unprecedented financial cost that will increase as the trial date is postponed,” Erika’s attorney said.
