Halle Berry’s ex-husband gained custody of son Maceo after busting accusations

Halle Berry’s ex-husband Olivier Martinez has been granted custody of their son Maceo, accusing the actor of strangling their 12-year-old child.

Page Six confirms the restraining order was filed Thursday, with the “Monster’s Ball” actress losing 50/50 custody in lieu of daytime visits with Maceo.

Berry will be able to see his son during court-ordered visits twice a week and on weekends.

Berry was also ordered not to come within 100 yards of Martinez.

The ex-lovers’ next hearing date has been set for October 16.

Berry, through his lawyer, denied Martinez’s shocking allegations, and the lawyer called the filing “completely meritless and deliberately misleading.”

“There is ample evidence, including multiple judicial decisions, that Olivier Martinez repeatedly violated court orders and interfered with necessary treatment and educational interventions to the detriment of himself and Halle Berry’s infant son, Maceo, an abuse for which Mr. Martinez is already legally sanctioned,” the actress’ attorney, Marina Beck, told Page Six on Thursday.

He also claimed Martinez had a well-documented history of “erratic, possessive and violent behavior.”

The statement concluded: “Halle is used to this kind of outrageous behavior from Mr. Martinez, and although she is deeply saddened, she will not let it deter her from fighting for Maceo’s interests and providing him with the love and support he needs.”

In court documents obtained by Page Six, Martinez alleged that on Sept. 26, Berry jumped on Maceo, wrapped her hands around his neck and strangled him.

The French actor claimed the argument started after Berry told Maceo he looked “stupid” and “very stupid” for playing games with virtual reality glasses.

“The situation escalated and Petitioner jumped on our son and began physically fighting with him,” Martinez said in the documents. “He grabbed Maceo by the neck and said, ‘Who’s dominant now?! Who’s dominant?!’ He started to strangle her while she was screaming. ”

Martinez claimed that Maceo, who panicked after the alleged incident, called him to pick him up and said he did not want to return to his mother’s house because he was “traumatized.”

In text messages included in the filing, Maceo asked his father to “come and choose.” [him] I am now on my feet after the alleged incident.

He then wrote to his father, “Are you here, please come.”

Berry and Martinez, both 60, were married for two years before splitting in October 2015. Their contentious divorce took eight years to finalize.

According to court documents obtained by Page Six in August 2023, the “Catwoman” star was ordered to pay Martinez $8,000 a month in child support.

As of April of that year, the “Unfaithful” star was also ordered to pay 4.3 percent of her income over $2 million; this will be considered “additional alimony” for Maceo.
